Purpose of the Role
The Senior Counsel, India reports to the Chief Counsel, India and AMEA. This role is one of two senior counsel roles in the India Business reporting to the Chief Counsel in a team of 9 lawyers and is responsible for delivery of legal support across any or all functions of the India Business Unit (BU). The Senior Counsel is a progressive, forward-thinking partner who provides strategic thought leadership and superior support to the India Business and is part of the Extended Leadership Council (ELC) of the Company. The role requires an elevated level of business orientation with focus on problem solving and supporting major projects, while upholding strong ethics and integrity across the organization.
The Senior Counsel is charged with providing high quality and responsive legal support and guidance to the India BU as part of the Legal team, as well as in developing strategy for the department; establishing collaborative relationships with colleagues both within and outside the local business; and managing external legal resources within budgets as guided by the Chief Counsel. 4 junior members of the Legal Team reports into this role and the incumbent is expected to mentor and coach these members of the Legal team.
Main Responsibilities
1. Provide legal support and risk evaluation by identification and interpretation of applicable laws and regulations; policy interpretation, development and conduct of training sessions; contract risk management; support or participate in Special Situation Management Teams; management of outside counsel; management of regulatory requirements for Mondelez India or its subsidiaries; transactional, restructuring or other Project related work as needed, in a lead or support capacity.
2. Active leadership and participation as a member of the India ELC, as well as contribute to the Global Legal function by providing legal advice in collaboration with Global and Local counsel and the Global Centres of Expertise (COE) and in regional and global policy development and implementation, reporting, and conducting training and new compliance programs respectively.
3. Provide legal support and risk evaluation to Categories, Functions and Manufacturing Facilities of the India Business Unit, as well as major projects. In particular, the Senior Counsel is expected to:
- reach out to and work alongside Business to meet strategic goals
- negotiate and draft contracts/ other documents for Business initiatives
- manage legal risk
- ensure appropriate protection of intellectual and real property
- interpret and apply relevant laws/ regulations
- manage outside counsel
- manage litigation and support for customer claims
- proactively extend legal support to Business in Special Situations
- lead cross functional teams in meeting Business critical initiatives
- plan and execute a risk-based training program across the company
4. Establish a culture of compliance throughout the Business Unit through all forms of advice, communication, role modelling and training and includes:
- overseeing corporate governance and compliance with law and policy
- policy interpretation, development, and training
- implementing effective compliance training programs for policies owned by the Legal function
- providing thought leadership on ethical issues
5. Participate in and contribute to the Global Legal department’s knowledge management and productivity building initiatives as agreed with the Chief Counsel on an annual basis.
